L\u2019article publi\u00e9 sur ce blog le 30 novembre dernier met le doigt sur une question sensible\u00a0: les cabinets vont-ils trop bien (ou pas assez mal) pour faire l\u2019effort de s\u2019adapter \u00e0 un monde qui change\u00a0?<a href=\"#_ftn1\" target=\"_blank\" rel=\"noreferrer noopener\">[1]<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019article cite une enqu\u00eate tr\u00e8s r\u00e9cente<a rel=\"noreferrer noopener\" href=\"#_ftn2\" target=\"_blank\">[2]<\/a> bas\u00e9e sur les r\u00e9ponses de 130 des principaux cabinets am\u00e9ricains selon laquelle ces cabinets ont connu une croissance de revenus comprise entre 3.5 et 4% pour les neuf premiers mois de 2016. La m\u00eame enqu\u00eate r\u00e9v\u00e8le cependant une baisse de la productivit\u00e9 des associ\u00e9s et constate que si les 100 premiers cabinets am\u00e9ricains s\u2019en sortent globalement bien, les performances fl\u00e9chissent lorsqu\u2019on descend dans le classement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le m\u00eame article cite un managing partner de cabinet qui d\u00e9clare \u00ab\u00a0 Au pays du droit, on ne souffre pas assez pour envisager de changer\u00a0\u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or, l\u2019enjeu n\u2019est pas de changer pour changer mais tous les observateurs et connaisseurs de ce march\u00e9 si particulier qu\u2019est celui du droit le savent, les cabinets quelle que soit leur taille ne peuvent se permettre de faire l\u2019impasse sur des questions telles que : Quel est l\u2019avenir des prestations juridiques telles que je les fournis aujourd\u2019hui ? Devrais-je me concentrer sur ce que je fais de mieux et r\u00e9duire le reste ? Dois-je me d\u00e9velopper par des alliances, de la croissance externe ou de nouvelles implantations\u00a0? \u2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab\u00a0Dois-je continuer comme avant comme si de rien n\u2019\u00e9tait\u00a0?\u00a0\u00bb, n\u2019est pas une option. Le changement est-il simple\u00a0\u00e0 mettre en \u0153uvre\u00a0? La r\u00e9ponse \u00e0 cette derni\u00e8re question est n\u00e9gative. Le changement implique des efforts et des risques. Mais ne rien faire dans un march\u00e9 en plein bouleversement est certainement pire. Les sceptiques pourront se reporter \u00e0 un article du <em>Harvard Business Review<\/em>\u00a0 (\u201c<a href=\"https:\/\/hbr.org\/2016\/11\/how-loss-aversion-and-conformity-threaten-organizational-change\" target=\"_blank\" rel=\"noreferrer noopener\">How loss aversion and conformity threaten organizational change[3],\u201d<\/a>\u00a025 Novembre 2016).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Comme l\u2019ont prouv\u00e9 les travaux\u00a0 de Daniel Kahnemann, prix Nobel d\u2019\u00e9conomie en 2002, la plupart des gens ont besoin d\u2019un rapport entre le risque de perte et le potentiel de gain de 1 \u00e0 2 pour accepter un pari \u00e0 50\/50.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alors comment le responsable d\u2019un cabinet d\u2019avocat peut-il surmonter ces freins? Voici quelques cl\u00e9s\u00a0:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Ne gaspillez aucune opportunit\u00e9.
